But there are other reasons which it is necessary that this question should go to the Secretary of State again. (1). The decision clashes with the decision given in the case of the Registrar of the Supreme Court of Mauritius, which I think must have escaped the Secretary of State's attention, and it affects all the Crown Colonies. (2). The arguments with which Your Excellency has supported it are as I have shewn in my letter of 16th January last based on the inaccurate and misleading information given to Your Excellency by Dr. Seth. And lastly the position which Your Excellency has of late assumed, and which I have described as entirely satisfactory to me, completely differs from the position first assumed. The Secretary of State's despatch therefore refers in great measure to facts which are no longer in existence. It approves of action taken by Your Excellency which Your Excellency has yourself abandoned. It is therefore essential that the papers should go home again, if only for the sake of informing the Secretary of State of the present state of affairs.
