In reply to Your Lordship's Confidential Circular Despatch of the 27th of last August, I have the honour to transmit the enclosed draft Order on the model of the "Draft Colonial Appeal Rules", enclosed in the Despatch under reference, together with a report by the Attorney-General and a Memorandum by the Chief Justice on Clause 2, and to request that the consideration of this Order may be postponed until the form of the new Appeal Court Bill, the draft of which will shortly be transmitted to Your Lordship, has been settled.

Now write to the Registrar of P.C. Explaining about the new Court of Appeal, other delay involved by their proposal, and sending the draft Order, A-G's report, and C.J.'s Memo. Ask him to settle the terms of the Preamble and the definition of "Court" in favour of hard cases with the law as obtains on the points raised by the A-G generally.
