(a) That the arrangement must be personal to the

present Judge, the Secretary of State being unable to

pledge himself to any permanent arrangement.

(b) That Sir H. de Sausmarez must rank as a Chief

Justice for the purpose, and if senior in appointment

to the Chief Justice of the Colony for the time being,

must take precedence over him and preside in the Court.

(c) That the attendance of Sir Havilland at Hong-

kong must be subject at all times to the exigencies of

the work at Shanghai.

(d) That the question of emoluments must be ar-

ranged with, and acceptable to, Sir H. de Sausmarez

himself and, so far as that is necessary, must be sub-

ject to the sanction of the Lords Commissioners of the

Treasury.
