"to place the Resident Engineer under the control of

"the Government alone and to relieve the Consulting

Engineers from further responsibility for the local

construction and to limit their functions to giving

"advice and assistance on such specific points as may

"from time to time be submitted to them".

It will be gathered from our previous remarks that

explained

in our opinion this paragraph originally and still expresses

the extent of our duties as Consulting Engineers for the

construction of the above railway, as was very clearly set

out in our letter accepting the appointment.

His Excellency further specifically refers to

paragraphs 11, 15 and 19 (c) of the memorandum of February

1006 in support of his contention and though our position

rests on the letter of our appointment it may be desirable

to refer to them.

Paragraph 11 while pointing out the undesirability

of interference with the Resident Engineer by Government

Officers in matters properly within the province of the

Consulting Engineers, proceeds to describe their duties almost

in the terms of our letter of January 25th 1906.

Paragraph 15 explains that the Government has under

the departmental system "the fullest measure of administrative
