To deal however with the specific point raised in paragraph 1

of his letter I may point out that although I understand as a

fact the Chief Justice hears all cases in Original Jurisdiction

he has the right to regulate the distribution of business in the

Court and there is nothing to prevent the Puiane Judge trying a

case in the Original Jurisdiction and with great deference I

fail to see any practical difference between the vote of the

"imported Judge" and a third Judge resident in the Colony, or

how the possible distribution of the work of the Original Juris-

diction between the Chief Justice and a Senior Puisne Judge af-

fects the question, the point being that whether the appeal lies

from either Judge there will a third Judge who will together

with one other of the Judges be able to bring a judgment to bear

unfettered by any idea of the case conceived in the court below.

2. (a) I have submitted observations on this in the last pre-

ceding paragraph.

(b) As to the delay in appeals from cases heard "during the

first half of the six monthly period" I scarcely think a suitor

would have much cause of complaint particularly having regard

to the infinitely larger period of delay usually existing at

home.

The Chief Justice assumes that two months, presumably one in the

Spring and one in the Autumn, will be alloted for appeals to

the New Court which he contends is insufficient and in this he

excludes for reasons stated two days weekly (Friday and Saturday)

from the reckoning.

I cannot of course criticise the views of

His Honour based on the knowledge of the workings of his own

Court but I presume he would so arrange the work as to make as

far as possible the two months available for the appeals to the

New Court and counsel and solicitors being aware of the regular

period fixed would have to arrange their cases accordingly, and

here suitors are resident on the spot and have no distance to

travel.
