that the necessity for two Judges had never been greater. I
should however have added that in view of the fact that two
of the leading Counsel were contemplating long holidays, the
pressure would be relieved and that certainly up to the autumn
of 1910, there would be no necessity for a Third Judge: but that
after that time it would not be expedient in the interests of
the public any longer to defer such appointment. I must further
point out that the remarks of those unofficial members of the
Council who thought a Third Judge unnecessary were not made
after papers had been laid before the Council. They were there-
-fore not in presence of the facts of the case.
