I have to acknowledge the receipt of your
letter of the 28th. ultimo.
In reply I have to say that the only means
which I can suggest for the protection in China of trade marks
registered in this Colony, but not registered in the United Kingdom, is by full recognition by the British Government of the
claims of prior usage in the Far East.This recognition and
protection would only require to be extended in China to the
marks of British subjects registered in Hongkong. London
registration of a foreign mark only protects that mark in the
United Kingdom, and would not come under the protection of
British diplomacy in China. As you point out the marks of the
subjects of other powers are registered here, but the protection
thus afforded will presumably under any new law be confined to
the limits of the Colony. If this is done foreign marks
registered here will be treated in the same way as similar
marks registered in London.
