I protest against the Chief Justice's
allegation that I observed secrecy in informing Your Excellency
of the conversation I had with Dr. Ho Kai on the subject of
the refusal to permit Mr. Ho Tung to occupy the Eyrie.
The Chief Justice having adopted the very
extraordinary course of discussing with the Senior Un-official
Member the decision of the Governor-in-Council in this matter
and having in his private letter of the 28th. of August to
you accused me, on the strength of such discussion with Dr. Ho
Kai, of breach of faith with certain leading Chinese in the mat-
-ter of an alleged understanding said to have been come to by
me with Dr. Ho Kai and others in regard to the exemption clause
in the Hill District Reservation Ordinance in 1904, I took the
opportunity of explaining my personal view of the question to
Dr. Ho Kai when he called upon me as described in the Chief
Justice's Memorandum of the 7th. instant.
I did not discuss with Dr. Ho Kai what took
plaos in Executive Council on the subject of the Chief Justice's
application to rent the Eyrie to Mr. Ho Tung nor any other
matters connected with the application.
