but the opinion of Dr. Ho Kai was forwarded to the Becretary of

State, and as one aspect of my contention was largely based on

Dr. Ho Kai's previous opinion expressed to me, it is inevitable

that this should have had weight with the Secretary of State

in approving the action of the Government. Apart from this the

case put by the Colonial Secretary to Dr. Ho Kai was incomplete.

The facts in the following paragraph have been shewn to Dr.

Ho Kai and assented to by him as accurate.

I asked Dr. Ho Kai to see me at the time last year when the

question of Mr. Ho Tung renting my house was being considered,

and discussed the matter with him, He informed me that he con-

-sidered it unreasonable to refuse to grant the exemption be-

-cause it would be a breach of the understanding come to between

the Government and the leading Chinese in the Colony, in virtue

of which the Chinese Unofficial Members of the Council had with-

-drawn their opposition to the Ordinance, and in virtue of

which also the exemption clause was introduced into the Ordi- -nance. The object of this exemption being to allow Chinamen of position in this Colony to rent houses on the Peak on

special occasions. Mr. Ho Tung's brother Mr. Ho Fuk was one of

the Chinese gentlemen who were sent for at the time and con- -sulted by the Government before this understanding was come to.

Dr. Ho Kai then intimated his willingness to interview the

Government on the subject.

A few days afterwards I informed Dr. Ho Kai that † had seen His Excellency the Governor on the subject, and that I had acceded to his wish that the matter should not be publicly re- -opened, and therefore I asked him not to trouble himself further in the matter. Afterwards, and in order to satisfy himself on the subject, he saw the Colonial Secretary and dia- «cussed the matter with him. The view of Mr. Ho Tung's case which the Colonial Secretary presented to Dr. Ho Kai as far as he could recollect was mainly the following:
