With reference to your Confidenti-

-al Despatch of July 31st. in which Your Lordship approved

the action which I had taken and the views I expressed

regarding the refusal of the Governor in Council to grant

exemption to Mr. Ho Tung from the operation of Ordinance

4 of 1904, I have the honour at the request of the Chief

Justice to forward a further Memorandum on the subject

together with the covering letter with which he forwarded

it to me,

The Memorandum oriticises the

action of the Colonial Secretary, and I enclose a copy of

a minute by Mr. May in which he explains his views of the

circumstances.

The Memorandum, as I read it,

challenges the authority of the Secretary of State to

decide such a question, though it was at his own request
