instant pointed out that the advice tendered to Your Excellency

by Mr. Seth has amitted one most important detail. What Your Excellency says in your letter of 6th. April on the subject of the Official Receiver in Bankruptcy, is also based on imperfect information. The Official Receiver is it is true not connected with the Supreme Court Registry, but he is an officer attached to the Supreme Court in its Bankruptcy Jurisdiction, and as such is under the control of the Chief Justice. The work could not get on if he were not. In England the Officers of the Bankruptcy Court have been transferred to the Board of Trade for reasons which, on Mr. Chamberlain's advice, were considered sufficient by Parliament in 1883. The Bankruptcy Officers of this Colony have not been transferred to any department of Government, and there are many reasons why they should not be. The Official Receiver therefore remains an officer of the Bankruptcy side of the Supreme Court; and he is in many things in intimate confidential relations with the Chief Justice who as Judge in Bankruptcy is his Chief.

I therefore with much respect and regret cannot admit that Mr. Wakeman is the proper person to bring to Your Excellency's notice the departmental insufficiency of the staff.
