of his plans, and claimed an indemnity from the Building
Authority, who was added as third party to the action by
the Court in spite of the opposition of the Acting Attorney-
-General.

The Crown Solicitor having advised
the Government that the case, even if it resulted favour-
-ably for the Building Authority, would not redound to the
credit of the Government, I decided to effect a settlement
without allowing the action to go to trial, and the claim
of the owners of Non. 88
N
92 was settled by payment to
them of the sum of $8,600, and by giving an undertaking
to pay the taxed costs of the owner of No. 86; these
costs have not yet been taxed and a further vote will be
required in respect thereof.
11.
The owners of Nos. 78 - 86 have
since brought an action against the Building Authority for
loss of rent and damages resulting from his failure to pass
the plans deposited by them in December, 1905, which action
is now pending.
