The departure of Mr. Justice Wise on a year's leave
intensifies the difficulties of the present situation, and if I
should unfortunately be prevented by illness from sitting for
even a few days the Court work will be most seriously dislocat-
-ød. I have explained this aspect of the question to Your Excel-
-lency personally. In order to supplement Tables already in
Your Excellency's possession showing the amount of work in the
Original Jurisdiction of the Court, I have had a statement
prepared showing the total amount of claims in actions brought
in the Supreme Court for the years 1901 to 1906 (the return for
1907 is not ready yet but it will probably be about the same as
1905.)
The extraordinary slackness of business in the two
years 1901 and 1903 has never been explained to me: but a coM-
parison of the tables shows that the work has very greatly in-
-creased of late years, and I have little doubt that the
figures of the last two years (1906 - 1907: about 24 millions)
may now be taken as the criterion of the business. The figures
for the year 1905 are of course above the average,
but they
require special notice in connexion with the present question,
as it was during that year that I first recommended the appoint-
-ment of an additional Judge, and it was during that year that
the
