I have the honour to forward, in the form
of a memoranduri, the observations which I submitted to Your
Excellency in conversation on Saturday last, as to the absolute
necessity for the appointment of a Third Judge to cope with the
business of the Supreme Court. In view of the many occasions on
which the Secretary of State has refused to entertain this
question favourably, I should have hesitated again to bring the
matter forward; but the departure of Mr. Justice Wise on leave
puts the matter in a different light, and I should be failing in
my duty if I did not report to Your Excellency for the informa
-tion of the Secretary of State the most unsatisfactory state
of affairs which exists at the present time.
