I have the honour to inform you
that a copy of your Confidential Despatch of October 12th.,
1906, addressed to my predecessor relative to the appoint-
-ment of a Third Judge was communicated to Sir F. Piggott
by the Officer Administering the Goverment to which the
Chief Justice replied on 19th. December, 1906, that it
was his "duty to report and that for the 4th. time since
May, 1905, that the work of the Court is in an imminent
state of deadlock, and that he found it impossible to deal
with the cases waiting for hearing in the Original Juris-
-diction, in Bankruptcy, in Chambers and in the Full Court
in such a way as is consistent with a due and regular
Administration of Justice". In reply Mr. May informed him
that he could not re-open the question of the appointment
of a Third Judge in face of Your Lordship's decision which
was final. In June, 1907, His Honour made a statement in
Court
