ed to acquire that portion of Austin Road which extended to

the west of Macdonnell Road in exchange for a portion of

Kowloon Marine Lot 36 surrendered to the Colonial Govern-

ment for the purpose of widening the public road on the

North side of the lot, as explained in Sir M. Nathan's

despatch No.204 of the 3rd. of August, 1905. (This will I

regret to say close the access of Austin Road to the sea

front).

In Austin Road there are a sewer and

storm-water drain, and it was a condition upon which the

Naval Authorities were permitted to take over the portion

of road referred to that "any drain or sewer existing, or

hereafter required, in Austin Road, should be provided with

an outfall along the line of the road proposed to be closed

or such other line as may be mutually agreed upon".

Sir M. Nathan in his letter to the

Commodore, in which he declined to withdraw the condition

to which the Lords of the Admiralty dissent, based his

refusal upon the grounds that such rights were invariably

reserved in all leases granted by the Colonial Government

whether to the Naval, Military or to private lessees.

Inasmuch however as the road area which formerly bounded

Kowloon Marine Lot 35 is now incorporated as part of it and
