Report on Ordinance No. 1

of 1907.

I have examined the accompanying Ordinance, entitled

An Ordin nce to amend the Probates Ordinance, 1897.

and I am of opinion that the Ordinance is one which is not contrary to

the Gocernor's Instructions.

The definition of Court of Probate in section 66 of the

Probates Ordinance 1897 recognizes in Scotland only the Sheriffs Court of the County of Edinburgh.

The effect is that under the existing law probate grented by other Courts of Probate in Scotland cannot be sealed with the seal

of the Supreme Court of Hongkong so as to be operative in the Colony. It is desired to remove a limitation for which there seems to be no

reason.

The paragraph seems to have been adopted without sufficiently consi- dering its effect from section 6 of the Colonial Prob:tes Act 1892.
