Hongkong Traders in their commercial dealings with Chinese, necessitated by the proximity of Canton, and the facilities which this afforded to fraudulent debtors to evade the payment of their just debts. It will not be denied that the persons most competent to express an opinion on the question whether this article works in satisfactory manner or not, are those who have the question daily before them. Their opinion is contained in my previous memoranda.

I propose now, without going over ground which has been already fully covered, to submit certain definite proposals for consideration, indicating those which I believe will be accepted without difficulty, and those which may require discussion.

First. That Judgments given by the Hongkong Courts in defended actions are to be brought by the Consul to the notice of the Chinese authorities, and their assistance requested in enforcing them. The request to emanate from the Supreme Court as indicated in my former proposal, the Court being satisfied that all efforts to obtain execution in the Colony have failed. The basis on which the assistance is invoked is the fact that the Courts have taken steps to arrange the matter as the Treaty requires. I agree that the application should be accompanied by a statement of the facts of the case in order to enable the Consul to explain it to the Chinese Authorities, but this for his information only, and not for the purpose of inviting an expression of opinion on them or a criticism of the judgment. The question of probability of appeal will require to be considered if the principle of the rule is adopted.
Secondly. In these cases that the strict interpretation of Article XXIII, with regard to "repairing to Hongkong to trade", and "bona fide absconding" will not be insisted on by the Consul.
Thirdly. That the first principle is to apply to cases where the defendant has obtained judgment in respect of his taxed costs.
