Your Petitioner would respectfully call Your Lordship's attention to the following facts:-

That of the five charges made against Your Petitioner three of such charges were vague in character with no specific date attached.
That of the remaining two charges, one related to an alleged offence which on the face of the charge made in respect thereof was more than three years old.
That the evidence adduced in support of the charges above referred to (so far as concerned the facts constituting the proof tendered in regard to the matters alleged therein) consisted entirely of the Statements of Chinese witnesses unsupported by the corroboration of any European witness.
(a) That the four European witnesses who gave evidence on Your Petitioner's behalf were witnesses who had been frequently in contact with Your Petitioner over a course of years and had had special opportunities of observing the mode in which Your Petitioner used to discharge the duties of his former office in regard to the payment off of crews.

Your Petitioner would respectfully urge that with regard to charge (a) made against Your Petitioner this charge is disproved by the letter addressed to Your Petitioner by Mr. Pulford the late Master of the Steamship "Alcinous" now Master of the Steamship "Cyclops" which is hereunto annexed.
