Before admitting the Ledger and Memorandum Book belonging to the witness Ko Ng, I took the opinion (copy of which I enclose) of the Attorney-General as to whether such evidence is properly admissible at a hearing of this nature. In view of Mr. Gompertz's opinion I decided to utilise the evidence which materially strengthened the case against Mr. Amy.
6. Mr. Amy's defence to the charge of accepting from the Manager of the Fuk Cheung Wo Kee Poultry Lane a sum of $25 was entirely unsatisfactory and left me in no doubt that he was guilty of the offence. The defendant's statement that the $25 were borrowed on a promissory note and that when repaid this note was not recovered was inherently improbable, and I believed the statement of the Manager, supported by his book-entry, made at the time, that the $25 paid to the Inspector was in connection with a structural alteration of his premises.
In these circumstances I concur in the recommendation of the Executive Council that he should be dismissed from the Public Service. I shall be glad to receive Your Lordship's decision in the matter by telegraph.
Mr. Amy was appointed locally as temporary District Sub-Inspector in the 18th and 3rd branch, &c.
