Referring to Your Lordship's telegram of the 29th January, 1907, stating that Mr. F. Sercombe Smith might have leave from Hongkong and that his appointment as Puisne Judge in the Straits Settlements would date from his assumption of office there, I have the honour to transmit for Your Lordship's consideration at the request of Mr. H. H. J. Gompertz of the Hongkong Civil Service, now acting as Attorney-General, a copy of a letter addressed by him to the Colonial Secretary, pointing out the effect of this decision on those officers of the Service who will get promotion by Mr. Smith's transfer.

I also enclose a copy of a minute in which I stated my reasons for not being able to recommend to Your Lordship that the pay accruing to Mr. Smith during part of his leave should be defrayed by the Government.
