This charge is of a fluvial character, especially as it appears that the price paid was little more than the market price.

There is no evidence of leading questions being suggested or of their being taken advantage of.

In fact, with considerable doubt, I cannot find that any improper thing is proved against Kelly except that he ordered food and did not pay for them. As to this, I am not satisfied that the articles were asked for by Kelly's order, but it is sufficient to say that Kelly's conduct in the matter was improper.

Mr. ... is imputed as bribes. I am not satisfied that the articles were given to Kelly as bribes. Mr. ... was dismissed.

I do not think that the conduct in the case was such as to justify dismissal.

Charge (d) is that Kelly obtained a quantity of eggs at ... from Tün... The evidence was given through an interpreter.
