The witness was led by leading questions, and the answers were put into the witness's mouth. If you read the answers without the questions, they consist of "It's yes" "I did".
Mr. Jacombe Smith ought to have known better. I regard this charge as not proved.
In my opinion, a light punishment may be awarded for the goods unpaid for - viz. we make him pay for all the goods he received & reprimand him. Or we do nothing.
I am sorry to differ from Sir C. Fiddes. There is much complaint, no doubt, the Chinese are unwilling witnesses, but we must not do what is improper from a judicial point of view because of the difficulty of proof.
