certain negotiations which took place between the Government and the Hongkong Hotel Company for the resumption of a portion of Kowloon Farm Lot No.3, and states, correctly, that the line of the railway was subsequently shifted in order to obviate the necessity of resuming any portion of this lot, as it was found that this could be done without any injury to the railway and a consequent saving of expense effected. It was, however, found impossible to lay out the line of the railway in such a manner as wholly to avoid Kowloon Farm Lot 4.

It is also alleged that the Hongkong Hotel Company was offered land in exchange for their property and the petitioner's architects claim that a similar offer should be made to them. The cases, however, are not parallel as the Hongkong Hotel Company's property was fully utilised and cultivated for the special purpose of supplying vegetable products cultivated in accordance with European methods to the Hongkong Hotel, the largest hotel in the Colony, the Chinese methods of gardening being very objectionable and even dangerous in the case of certain vegetables; and the Government was desirous of assisting the Hotel Company in its laudable endeavours to safeguard the health of their visitors: whereas the area required from
