I think both questions must be

answered in the negative. I think it is clear that if Mr. Vise accepts the appointment of acting Attorney General he

cannet retain the office of Puisne Judge even though he

performs none of the duties of that office.

The acceptance of the Attorney

Generalship would ipso facto avoid his office of Puisne Judge (Supreme Court Ordinance 1873 Section 11) and on the

avoidance of that office the salary thereof would cease

(ibid). It would consequently be a contravention of the

Ordinance to continue to pay him any part of the salary

attached to the office of Puisne Judge.

The avoidance of his office of

Puisne Judge by Mr. Wise on acceptance of the Attorney

Generalship would make the office "vacant" within the meaning of section 10 (1) and the Governor would then have

power to appoint another fit person to fill that office (ibid). If thereafter it was desired to restore Mr. Wise

to the Bench of the Supreme Court it would be necessary to

appoint him by Letters Patent under the Public Seal. If in

1902 Mr. Wise, being then Puisne Judge, acted as Attorney

General and subsequently resumed the duties of Puisne Judge

upon the appointment of the Attorney General, I am of

opinion that before resuming such duties he should have

been re-appointed Puisne Judge by fresh Letters Patent inasmuch as by accepting the office of Attorney General

while holding the office of Puisne Judge he had, by virtum

of the Supreme Court Ordinance 1873 section 11, avoided

his office of Puisne Judge. If such has not been the case

I advise that fresh Letters Patent, antedated as of the

day in 1902 on which Mr. Vise resumed the duties of Puisne

Judge, be issued to him, and that, if and when it shall

become necessary a validating and indemnifying Ordinance

be passed.
