Marine Lot No.49. The original lot with this designation abuts on the Western end of Gasoolgne Road South and by the conditions of sale for the extension it was provided that the purchaser should extend the 100 feet wide Gascoigne Road for the full depth of the lot and should pay for cert- ain public drainage works involved by the extension. Advantage is being taken in this case of the usual condi- tion, that the material for the reclamation should be taken from places approved by the Director of Public Works to get cut down the hill, over 100 feet high, which has to be removed for the continuation northwards of the Robinson Road and the completion of Gascoigne Road North. I have mentioned this case as the extension works being under- taken have no doubt come under Your Excellency's notice and the great public improvement that will be effected thereby has doubtless been appreciated by Your Excellency.

A case which is however more t the point in connection with the proposed road and reclamation for the foreshore at Forth Point is that of the last lot sold

the neighbourhood of that Point, viz:- Marine Lot To.285, referred to in paragraph 4 of my letter of the 31st. Hay. I enclose a copy of the Particulars and conditions of the lotting by Public Auction Sale of this lot on the 21st. March 1904 and would direct Your Excellency's attention to the special conditions Mos.l to 8 and more especially to No.6 which is the condition with respect to obtaining earth for the reclamation to which I have already generally referred. In this instance advantage has been taken of the condition to get cut down a hill for the formation of part of the same 100 foot road as the one which is to pass in front of the Morth Point Battery. Your Excellency will observe that it is not proposed to make any refund to the purchasers on account of this work such as I have suggested in the 5th. paragraph of my letter of the 31st.
