he would receive some payment in consideration of the fact

that he had to live near the Gaol; indeed, he did not

raise the question until 3 months after the date of his

appointment.

with the first paragraph of Mr. Moore's 4th. reason which

correctly states the facts. As regards the third sub-para-

-graph Mr. Moore's "right" to occupy other free quarters

in the Medical Department would certainly not have been

admitted by me. The quotation from the Principal Civil

Medical Officer's letter of the 12th. February, 1906, given

in paragraph 2 (d) of this Despatch embodies no admission

of a right here but rather a distinct intimation that the

occupation of free quarters would be as of grace. The

inference as to an allowance in lieu of quarters which Mr.

Moore draws from his false premiss therefore falls to the

ground. I would add that the fact that house allowance is

lapsing to the Treasury does not weigh with me in consider-

-ing whether an Officer is entitled to that allowance.

With respect to the last reason

advanced by Mr.

Moore. the terms of the letter of appoint-

-ment so clearly excluded the terms of General Order 36 (1)
