(c). (1) that as the letter of appointment

did not refer to or exclude General Order 36 (1), that

General Order was impliedly incorporated in the terms of

appointment.

The letter of appointment excluded General

Order 36 (1) by stating that the appointment was without

quarters or allowances of any kind.

(2) that there is a house allowance

provided in the Estimates for the Medical Officer of the

Gaol which is lapsing on account of Dr. Thomson living in

free quarters during Dr. Atkinson's absence on leave.

The allowance provided for Dr. Thomson

appears in the Estimates as an allowance for an Assistant

Surgeon and not as one for the Medical Officer of the Gaol.

(3) that if General Order 36 (1) does

not apply to him, he will be treated differently from

other Assistant Surgeons, which was not intended.

The only other Assistant Surgeon on a

sterling basis is Dr. Koch who drew Dr. Thomson's house

allowance when that Officer was on leave under circums➡

-tances to which I will refer later.
