THIS INDENTURE made the Twenty eighth day of January One
thousand nine hundred and five BETWHEN FUNG WA CHUN
otherwise YEW CHEONG of Victoria in the Colony of
Hongkong Compradore and Coal Merchant (who and whose
heirs executors administrators and assigns are where
not inapplicable hereinafter included under the designation "the Mortgagor") of the one part and THE
NATIONAL BANK OF CHINA LIMITED whose registered office
is in London (who and whose assigns are where not
inapplicable hereinafter included under the designation "the Mortgagees") of the other part WITNESSETH that in
consideration of TWO HUNDRED THOUSAND DOLLARS to the
Mortgagor now paid by the Mortgagees (the receipt whereof the Mortgagor doth hereby acknowledge) The
Mortgagor doth hereby covenant with the Mortgagees that
the Mortgagor will pay to the Mortgagees the sum of Two
hundred thousand Dollars on the Thirty First day of
December One thousand nine hundred and five with
interest thereon in the meantime at the rate of eight
Dollars per cent per annum from the date hereof until
repayment of the whole of the said sun of Two hundred
thousand Dollars by equal monthly payments on the
Twenty eighth day of each and every month without any
deduction AND THIS INDENTURE ALSO WITNESSETH that for
the consideration aforesaid The Mortgagor DOTH hereby assign unto the Mortgagees ALL THOSE FORTY THOUSAND
TONS OF COAL and all other the Coal in Fati Canton of
which Shewan Tomes and Company have at the request of
the Mortgagor taken charge TO HOLD the said Coal unto
the Mortgagees absolutely PROVIDED ALWAYS that if the
Mortgagor shall on the said Thirty first day of December
One thousand nine hundred and five pay the sum of Two
hundred thousand Dollars and interest as aforesaid unto
