the Bank in good faith and that the coal when seized by

the Viceroy was the property of the National Bank of China,

Limited.

The present state of the case is

that I am having the discrepancy between the statement of

Fung in his Statutory Declaration of the 17th. of November

and the statements of the Viceroy in his Despatch of the

8th. February investigated. When this has been cleared up

to my satisfaction I propose 28 suggested by Sir Ernest

Satow in his telegram of February 18th., to send to the

Consulate-General at Canton for examination such Chinese

witnesses as will go.
