Referring to correspondence on the subject

of a proposal by this Government to construct a 100 foot road through the Northern portion of War Department Land at North Point which terminated with Mr. May's letter No. 1454 addressed on the 8th. December, 1904, to the Commanding Koyal Engineer, 1 have the honour to inform Your Excellency that I am advised that the time has arrived when it will be convenient to reopen the consideration of the conditions under which the land required

can be resumed for the purpose indicated.

Colonel L. P. Brown, Commanding Royal Engineer, in his letter No. A/2875/6 dated the 81st. October, 1904, stated when the ratter was last under consideration that be was prepared to recommend for War Office acceptence the fol-

-lowing conditions in which reference is made to a plan of

which a copy is no doubt in Your Excellency's possession,

There must be no interference with War Depart- -nent Land South of blue edged line on pien herewith enclosed.

The slope worth of blue edged line to be kept in a sound condition by Public Works Department. The area (58,429 square feet) shewn green on plan to be reclaimed with material from road cutting, and to be handed over to War Department as a Marine Lot.

but in lieu of (iii) propose that the War Departrent should be

credited
