I am commanded by My Lords Commissioners of the

Admiralty to acquaint you for the information of the

Secretary of State for the Colonies, that in connection

with the Admiralty Extension Works at Hong Kong, an action

as recently been brought by the local Colonial Authorities

against the Contractors, Messrs. Punchard Lowther & Co.,

for employing certain junks as Cargo boats without a

license.

2. Attention is invited to Clause 22 of the Con-

-ditions of contract, copy enclosed, under which the

Contractor's plant becomes for the time being the absolute

property of the Admiralty.

From the newspaper cuttings, also enclosed, it

will be seen that the local Magistrate ruled that the

junks in question are the property of the Contractors and

that they must take out licenses.

4. My Lords however do not accept the interpretation

of the Magistrate as affecting their rights under the

contract. The vessels in question were employed solely

on Admiralty work and there seems no reason why licenses

should be required in respect of them any more than the

other numerous small craft attached attached to the Naval

Yard. If payments are exacted, and licenses insisted on,

it is thought that it might possibly be arranged that the

Colony shall refund any money received in connection with
