With reference to your letter of the 21st

June 1905, No: 20625/1905, relative to the acquisition

by the Admiralty of certain land at Hong Kong near Mount

Parish, Wanchai; I am commanded by the Lords Commissioners

of the Admiralty to acquaint you, for the information of

the Secretary of State for the Colonies, that they are

glad to learn that the Colonial Government are prepared to

accept the amendment proposed by the Admiralty in Clause 3

of the Memorandum of Transfer, viz : that in the event of

the Colonial Government resuming possession of the whole or any part of the green area they shall refund the whole or proportionate part of the premium paid, X 11,772, in addition

to paying compensation for any buildings thereon.

2. My Lords do not agree with the Colonial Gov-

ernment's view of the transaction in regard to the transfer

of the red area.

They are however prepared to acquiesce in the

addition of the words : "without the express consent of the

Colonial Government to Clause 5 of the Memorandum as

suggested by H.E. the Governor, provided the words : *which is not to be unreasonably withheld" are added thereto.

3. My Lords will be glad to know what course

is proposed to be adopted in order to give effect to the

amendments in the Memorandum of Transfer.
