In the 3rd, oзragraph of my letter No.1588/1904 deted the
21st. October, 1905, on the subject of 'The Peak Tramway Bill' now
before the Legislative Council, I suggested that before the Eill was
read a third time terns might be arranged by the Military Authorities.
with the Tramway Company for the surrender to that Company of the
part of the Wer Department Property ab Murray Fattery required for
the undertaking,

I am now advised that in accordance with paragraph 5 (2) of
the Colonial Office Circuler of the 9th. June, 1890,on the Disposal of
Military Crown Lands, referred to on the first oege of Colonel Lewis'a
Memorandum, of which Cicular a copy is enclosed, the oroper procedure
with regard to the piece of land now in question will be for the War
Department to surrender the band to the Colonial Government, for that Government to sell the lease of the land to the Peak Tramway Conoany La the usuel way, and for the proceeds of the sale to be placed to the
credit of the War Department in the Military Lands Account.

This orocedure will of course not debar Your Excellency
from making such arrangements as may be necessary from the point of view of the defence of the Colony, la connection with the trensport of men and stores by the Tramway,conditions precedent to the surrender of the property to the Colonial Government for the ourcose
of subsequently being made available to the Tranway Comoany.
