Referring to the second paragraph

of my Despatch No. 128 of the 13th. May, I have the honour

to inform you that the time allowed to the Appellant in the

Cheung Sha Wan Case to complete the prescribed security to

prosecute the appeal to the Privy Council and pay the costs

thereof expired upon the 15th. instant and on the applica-

-tion of the Crown the Full Court dismissed the Petition

for leave to appeal on the 27th. instant.

The Decree of the 31st. March last

embodied in the Judgments forwarded to you in my Despatch

No. 166 of the 28th. ultimo is therefore absolute. By that

Decree the Full Court, confirming the Judgment of the Land

Court, disallowed the claim of Tang Tsz U to the foreshore

and waste land at Cheung Sha Wan Bay known as claim C.A.

Survey District No. 4, and the title of the Crown is now

undisputed.
