I have the honour to transmit herewith a 04
copy of a report by the Harbour Master on Mr. H. J. Murray's
letter of the 20th. December last a copy of which accompanied
your Despatch No. 366 dated the 23rd. idem. A copy of the
original summons in the case was forwarded in my Despatch No
Enclosure 1.

As you are evidently uncertain as to the
correctness of the views on this case expressed by me in para-
graph 3 of the last mentioned Despatch, I have thought advis-
able to refer all the papers connected with it to the Acting
Chief Justice and I now enclose a copy of Sir Henry Berkeley's
minute thereon.
