Answer that DMOR GORN this is a case in which the Crown has no legal claim of the amount & compensation is therefore at the discretion of the Crown. It would be unusual in such a case to give Considerations by which the govt should be guided & would lead to prolonged correspondence without

The matter has been most carefully gone into. Mr. Lyttelton is satisfied that the sum offered is adequate & generous, as he regrets that he cannot proceed further in the matter to which the fullest attention has been given both by the Hong Kong govt & by himself solely

I have the honour to acknowledge receipt of your letter of yesterday's date No. 53085/1904, informing me that Mr. Secretary Lyttelton has now received the Report of the Acting Governor of Hong Kong with regard to our claim for further compensation in respect of Marine Lot No. 184; and that, after full consideration, he regrets that he cannot interfere further in the matter.

This result is not different from the substantial justice indicated in Mr. Secretary Lyttelton's instructions to Governor Sir Henry Blake under date 31st October 1903 that I have to ask to be allowed to peruse the Report of the Acting Governor of Hong Kong, in accordance with the dictum of Chief Justice Sir John Carrington in his judgement of the 1st December 1900 where it is stated, as follows: - "Although the legal right may not be clear, yet it cannot but be a point of honour with the Government to pay full regard to any alleged right." And when such a right is alleged, I think it right to give opportunity of setting forth the grounds on which the alleged right is based and of knowing any facts and reasons which may be in opposition to it.
