In further reference to your Excellency's letter C.3.0., of 19th January last, to the Naval Commander in Chief, regarding the question of payment for clearing away debris from the Albany Nullah which passes through Admiralty property, I have the honour to acquaint your Excellency that on the matter being represented to His Excellency the General Officer Commanding, a reply (copy enclosed) was received that the War Department declined to admit any liability.

I would point out to Your Excellency that the Admiralty have done their part in providing a fall to the new entrance of the Nullah equal to the old, and giving a free outfall not originally existing, and in consequence should not be burdened with all liability for expenses which may be due to natural causes or neglect on the whole course of the Nullah above Admiralty property, as the replies received from Your Excellency and His Excellency the General Officer Commanding seem to me to imply.
3. I beg therefore to lay the matter again before Your Excellency with a view to the question of such liability being considered by Your Government and for opinion as to how the cost of such damage may be equitably divided.
