The question seems to me to turn on the time when in accordance with par 3g the Govt the a free title or gave undisputed possession.

Up to that have any payments by the purchasers were merely speculative. It is common that they could not be said to have established their title until the receipt of Colonial Secretary's letter the... over 12 yrs ago.

The Governor might have prevented the letter being granted. It is however open to argument that the title was established at the date the court, J the profit of the land because from that time the reads was entitled either to the land or to compensation.

I incline to the former view, having regard to the state of the govt in 37485.

The compensation would have been payable to the reads not the purchaser & the purchaser knew all the way along that he could only make money ...
