Bill all The decision seems to me to be unjust to No Hageland because (1) he has hitherto been told by this office that he would be considered for promotion 事 (2) he has for 3 years had opportunity and been allowed to act in the post which he likes, this evidently to his satisfaction.

On the other hand it is important to adhere to our declared policy of preserving the post for Bar-qualified cadets.

The moral is that we should not allow persons who are debarred from filling permanent posts to be considered for them. If the man plainly is ineligible, why not offer to consider his claims with others for service elsewhere if he desires it.

On the whole I should like to know how it is put in the draft please at once.

443 I have the honour to transmit herewith an application from Mr. F. A. Hazeland to be appointed 1st Police Magistrate in this Colony in the event of that office being vacant.

2. Mr. Hazeland, whose official career is recorded in his application, is not a member of the Eastern Civil Service. He holds at present the substantive post of Second Police Magistrate.

3. His special qualifications for the appointment are that he is a Barrister-at-Law of nearly 5 years standing, that he acted some little time ago for 3 years in the post for which he applies, and that, according to information furnished to me, his reputation as a Magistrate among the legal profession at Hongkong stands very high.

4. On the other hand there seems to me to be a grave objection to the appointment in question being given to a gentleman not belonging to the regular Civil Service when there are Officers of that service qualified for it, and in this connection I would remind you that my predecessor in his Despatch No. 331 of the 24th August, 1901, when forwarding...
