I have the honour to transmit at the request of Messrs. Ewens and Harston, Solicitors of this Colony, an appeal dated the 22nd September, drawn up on behalf of their clients Messrs. E. S. Kelly and Ellis Kelly against the decision of this Government, communicated to them on the 26th May, 1904, declining to recognize any right on the part of their clients to compensation in connection with the claim of one Ho Lap Pun to land and foreshore between Ngau Tau Kok and Lyeemoon.

I also annex a copy of a letter from Messrs. Ewens and Harston dated the 18th May in which their claim was put before this Government together with a copy of its enclosures.

The claim of Ho Lap Pun (with another which does not affect the present appeal) was dealt with in His Excellency Sir Henry Blake's Despatches No. 289, dated the 17th June, 1903, CO 882/8, and Confidential, dated the 20th August, 1903, and Mr. Lyttelton's No. 10 of the 9th January last. The first of these Despatches explained the original difficulty in dealing with the case.
