Sir,
We have been instructed by the Board of Directors of the Tung Wa Hospital to examine the title deeds to the various leasehold properties purchased by, and for and on behalf of, the Hospital. It appears that the Assignments to, or for the benefit of, the Hospital have been made in various ways, some to certain of the Directors, and others to the Colonial Secretary and the Hospital. Inasmuch as by Section 2 of Ordinance No. 8 of 1870 express power was given to the Tung Wa Hospital to hold lands, and to sue and be sued in that name as a corporate body, it appears to us to be somewhat absurd, and certainly most inconvenient, that the legal estate of these various properties should not be vested in the Hospital for whose benefit they were purchased, and we are instructed to take the necessary steps to put the matter right.
We shall be glad to know whether, under the circumstances, you are prepared to execute a Deed of Assignment to the Tung Wa Hospital of such of the properties as may have been assigned to the Colonial Secretary and his successors, or to the Colonial Secretary and his successors and to the Hospital, for the benefit of the latter.
The title deeds, it seems, are all deposited with the Colonial Treasurer whom we shall be glad if you will authorise to hand them over to us for the purpose of enabling us...
