A BILL
ENTITLED
An Ordinance for the expulsion of indigent aliens in time of war.
WHEREAS a state of war unhappily prevails and it is necessary to take due precautions for the safety of the Colony:
Be it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:--
1. The Governor in Council may on the representation of the Captain Superintendent of Police that there is in the Colony any person not being a natural born or naturalized subject of His Majesty, who is possessed of no real or personal property in the Colony and who by reason of the existence of hostilities has no lawful occupation or employment, or means of livelihood, by order prohibit any such person from residing or being within the Colony during the existence of hostilities and may by the same order fix the time for the departure of such person from the Colony.
2. It shall be in the discretion of the Governor in Council to order that any person named in any such order be detained in custody of the Police until he leaves the Colony, and such person may thereupon be arrested and shall be deemed to be under lawful arrest until he leaves the Colony or until the final departure from the Colony of the vessel in which he leaves.
3. Every person who has been prohibited under the provisions of this Ordinance from residing or being within the Colony and who without lawful authority or excuse, the proof of which shall be upon him, is in the Colony after the date of such order or after the time fixed for his departure, shall be guilty of a misdemeanour and upon conviction thereof before a Magistrate shall be liable to imprisonment with or without hard labour for any period not exceeding one year.
4. Any person who knowingly harbours or conceals any person against whom a prohibition order has been made under this Ordinance shall on conviction thereof before a Magistrate be liable to a fine not exceeding fifty dollars or in default of payment to be imprisoned with or without hard labour for any term not exceeding six months.
