With reference to the Despatch of the Secretary of State (X: #10 of the 14th November 1903), I beg to submit the following statement, in which I will deal as concisely as possible with the various points raised.
On the 21st May, 1902, Messrs Leigh & Lorange deposited a plan containing sections of the tramway for my approval under Section 13 of Tramway Ordinance (No 10 of 1902).
Copy of my letter No. 615 of 26.06 to Messrs Leigh and Lorange is inclosed.
I declined to approve of the plan on the grounds that it did not comply with the decision of the Technical Adviser of the Board of Trade (Colonel Yorke) in the matter of the bed of concrete underneath the rails and I returned it for amendment.
It is evident from Messrs Dickinson's letter of the 5th November, 1903, that the terms of my letter were communicated to them by their local representatives, but I may also point out that Messrs Dickinson and Co were well aware beforehand that the plan did not fulfil the requirements.
