Whereas the Governor of Hongkong has been pleased to appoint a Sanitary Commissioner.

Be it enacted by the Governor of Hongkong with the advice and consent of the Legislative Council thereof, as follows:

Notwithstanding anything contained in "The Public Health and Buildings Ordinance, 1903", the Governor shall have power to appoint the Sanitary Commissioner for the time being a member of the Sanitary Board as constituted by "The Public Health and Buildings Ordinance, 1903" and when appointed such officer shall have all the powers, privileges, and authorities of any other ordinary member of the said Board.

Such Sanitary Commissioner shall be paid from the Colonial Treasury such salary and allowances as the Governor with the consent of the Legislative Council may from time to time determine. He shall be the Administrative Head of the officers and servants of the Sanitary Board and shall give such directions as may be necessary for the carrying out and giving effect to the decisions of the said Board.

Section 15 of the "Public Health and Buildings Ordinance, 1903" is hereby amended by the substitution of the words "Sanitary Commissioner" for the words "Medical Officer of Health" in line 3 of sub-section (1) and by the substitution of the words "Sanitary Commissioner" for the words "Medical Officer of Health" in lines 1 and 2 of sub-section (2).

Section 30, sub-section (2) is hereby amended by the addition of the words "with the consent of the Sanitary Commissioner" after the word "however" in line 2.

Section 226 is hereby amended by the substitution of the words "Sanitary Commissioner" for the words "Medical Officer of Health" in line 3.

Section 256 is hereby amended by the insertion of the words "Sanitary Commissioner or of the ..." before the word "Secretary" in line 4.
