That the War Dept. should be credited with the value of the land surrendered I allowed to receive other land in the Colony of equal value;
The value of the land for this purpose being defined as follows;-
In the case of the land over which military rights are fully exercised for rifle ranges or field exercises, the value is the difference between the value of the land in the open market (for building) and as agricultural land, subject to the war Dept. rights aforesaid.
Their Lordships will however perceive that a difficulty has arisen, owing to the fact that the Naval authorities have rights over the land, of which this dept was not aware when the above conditions were proposed.
