:I recommend that a lenient view be taken
of the offence which is clearly proved - but that it be taken
into consideration with regard to his promotion which has not
been confirmed.

This man having been tried and acquitted
on the criminal charge: am of opinion that no action be taken
that could be construed as an attempt to go behind the verdict
of the jury.

There are many precedents in the borce for
.abiding by the issue of a trial in such cases though Government
.may not be 'satisfied with the verdict.
The offence against discipline then alone
remains to be considered.
For this offence which is proved,.i would
recommend that Erimble be reduced to the rank of Constable.
Further I think Government would be: justi-
*fied in requiring that before he is re-enlisted at the expira-
tion of his 5 years' service leave to re-enlist him be asked by the Captain Superintendent of Forice.ancompanied by a full report on bis.conduct.between this date and the expiration of his present term of service which will expire in March 1905.
