fell down and the defendant went away. The man kicked was

stranger to me. When I last saw him I saw blood running down

his trousers. I went away and I went away leaving him there.

Next time I saw him was at the Government Civil Hospital and

he was then dead.

Crossexamined by Mr Slade:- I only saw the man that evening

and when he was dead. Twice when Sergeant came out the rowd ran away. The man kicked was on the pavement just in front of the brothel. He stood there looking on. I ran away with the

rest. I walked away and remained next door. The Sergeant did

not hit me. He waved his two hands. He got some of them on

the face. I only saw one other man tumble down, a man who then picked himself up and ran away, that man was not kicked. The police asked me to give evidence. I did not see Lai Shi. The street was crowded that night. It was about 7 p.m.

Mak Kun declared:- I live at 56 Temple Street Yaumati, Master

of a Coffee shop, next door but one from the brothel. I remember 3rd August evening, a disturbance and a crowd collecting, a number of persons ran past my shop. I walked out and on the left side I saw a hawker coming away from the door of the brothel. I saw a police sergeant (prisoner) following and there was an old man between 50 and 60 standing then under the verandah Then I saw the Police Sergeant give the man a further kiek (shows position of kiek). The old man fell down and the sergeant went away and the old man got up and went away. I had not seen the old man before. Next I saw him at the Government Civil Hospital when he was dead. It was the same man. I saw him kicked on 3rd, and on the 8th I saw

his dead body.
