observations and explanations and he was requested to send in
his reply on or before the 10th. October.
On the 14th. October the time for Mr
Norton Kyshe's reply was extended to the 20th.of October, and
at the same time I directed that his vacation leave should
commence on the 15th. October and that he should be allowed to
remain on leave in the Colony till that date or as soon there-
after as he might be able to leave the Colony.
I considered that Mr. Norton Kyshe had had
ample time in which to reply to the Report and as complaints
had been addressed to me by two of the Solicitors who had
given evidence before the Commission of Mr. Norton Kyshe's
behaviour towards them in the Registry, it was evidently
desirable that Mr. Norton Kyshe should be deprived of any
excuse for delaying his reply and his leave.
This action had its effect for on the 15th.
October Mr. Norton Ky she furnished his reply. I have infomed
him that it will be forwarded with the Report by the Mail of
the 24th. instant, together with copies of the documents
enumerated in the enclosed schedule which Mr. Norton Kyshe
has asked should be sent to you as he refers to them in his
reply. Mr. Kyshe is leaving by the same Mall.

Mr. Kyshe in his voluminous reply has
pointed out every point in his favour, and the answers to
certain of the questions, for instance 944 and 945 show that
in certain cases in which objection was taken to his decisions
they were upheld on appeal to the Chief Justice; but the
perusal of the correspondence will show that the relations
between Mr. Norton Kyshe and the Judges are strained to the utmost
