With reference to your Despatches No. 393

of the 20th. November, 1902, and No. 192 of the 22nd. May last,

I have the honour to forward a further minute from the Attorney-

General which he has requested may be submitted for your con-

sideration.

Sir Henry Berkeley contends that when

Counsel's fees are awarded cgainst an opposite party and are

included in the Bill of Coste, such fees must be paid to the

Barrister representing the Crow. If not so paid then their

inclusion in the Bill of Costs is illegal and should be dis-

continued.

He also requests that he may be allowed

to draw these fees because, in such cases, he appears, not

*virtute officii" as Attorney-General, but simply as a Barris-

ter on behalf of the Crown.

I regret that in my Despatch No. 436 of

the 30th. September last you were, on the authority of a

minute by the Crown Solicitor, copy of which is enclosed,

misinformed as to the cases in which fees are charged when

nclosure 2.
